Objectives and guidelines for future legislation on space operations

It is the intention of the Federal Council that the future legislation on space operations implements the UN space treaties ratified by Switzerland and introduces a licence requirement and the supervision of space operations. In addition, it should contain rules on liability and establish and maintain a national register for space objects.

The drafting of the act and corresponding ordinance will be based on the guidelines set out in particular in the 2023 Space Policy. The new federal act will mainly regulate Swiss satellite operators; suppliers and manufacturers of satellites or satellite components will not be affected.

In view of the above, the legislation (act and ordinance) shall:

  • provide a secure legal framework for public and private players in the space sector;
  • ensure Switzerland remains an attractive business location for public and private space operations, and promote the competitiveness of Swiss players in the space sector by providing a flexible framework that encourages innovation and minimises bureaucracy;
  • include the necessary risk mitigation provisions and ensure effective, safety-oriented oversight of space operations;
  • address the sustainability of space activities and the prevention of pollution on earth and space;
  • strike a fair balance on the financial interests of the Swiss state and damages occurring from space-related incidents.

The act shall contain only the basic essential requirements – the details shall be laid down in the ordinance. In addition, the act shall ensure that the Federal Council can react promptly to technological and economic developments and to potential new international regulations by means of delegation provisions.
